Per our recent telephone conversations, the OCG states the following in regards to the Queen of Hearts raffle:
A raffle prize cannot exceed $100,000 per the State Code (See Va Code § 18.2-340.33(11)).
As your prize is nearing the $100,000 maximum, the organization should follow these guidelines:
Should a Queen of Hearts prize grow to the $100,000 maximum raffle prize allowed before the Queen of Hearts is picked, the prize must not continue to grow beyond the $100,000 limit. Any Queen of Hearts sales that occur after the $100,000 maximum raffle prize is reached for that particular game will be retained by the organization to be used in accordance with the Charitable Gaming Statute and Rules and Regulations. Additionally, organizations may not “roll over” or progress the excess prize amount to a new Queen of Hearts game.
Although the maximum raffle prize amount has been reached, the organization must continue selling tickets (per its Rules of Play) and conducting drawings until the Queen of Hearts has been picked.
The organization must report the total sales on its financial reports. Once the Queen of Hearts is picked and the prize is awarded, the organization may choose to start a new Queen of Hearts game board. Again, at no time, can receipts from one Queen of Hearts game board roll over to a new Queen of Hearts game board.
